Over the years, I have bought and sold homes, but it wasn't until this year that my wife and I broke ground on building our own home. This house is still under construction, but we already have had a number of learnings that I would like to share.

Finding The Right Land

When it comes to buying the right piece of land for your dream home, it would be easy to fall back on the real estate cliché of location, location, location. That may be true but I would add one more consideration -- zoning.

For most people their dream home is more than just the house, it may be a house and an ohana (cottage), it may involve having horses, it may be about privacy and low density. Zoning places restrictions and requirements on a parcel of land, and as such, you should discuss what your complete dream is with your REALTOR and then together determine which zoning would be the most compatible with your vision. For example, if your dream includes horses and you are willing to dedicate 50% or more of your land to some sort of agricultural pursuit, then an agricultural zoned lot may be perfect for you. Conversely, if you have no interest in anything remotely agricultural, then an ag lot maybe be the last thing you should own.

Design - Building Options

Once you have land, it is now time to design and build. There are a number of options here on Maui, ranging from using a full service design build company to design the house and managing the project yourself as an owner builder. The best option for you is dependent on how much of your own time and energy you want to invest in this project.

A design-build company is one stop shopping. You sit down with them, explain your vision and they do the entire project to completion. The advantage to this approach is that everything is done for you.
There is also the more classic approach of hiring an architect to design the house and then hiring a general contractor to build the house. The advantage to this approach is you can use the architect and builder of your choice. It is also possible to use a mainland architect as the plans need to be stamped by either a licensed Hawaii architect or a licensed Hawaii engineer.

As you may have just figured out, you don't need an architect at all, but could actually design the house yourself and have a draftsperson do the drawings. This is the approach we took and allowed us to create a house that would meet our unique needs.

It is a very personal decision whether you hire a general contractor or be your own builder. If you think that words like micro-manager and control-freak describes you well and you take them as a complement, you may want to be an owner builder. My wife and I decided that it was for us as we want to have the satisfaction of knowing we did some of the work ourselves and are comfortable managing the project.
If you go the owner builder route, here are some suggestions and things to be aware of:

Hire a "permit expediter" to handle your building permit submission to the County of Maui. We can make it very easy for you but we’d like to give you a few tips that should be considered before taking this important first step in realizing your dream of owning on Maui.

The contract begins with this simple statement:

THIS PURCHASE CONTRACT BECOMES A LEGALLY BINDING CONTRACT FOR THE PURCHASE OF REAL ESTATE UPON EXECUTION BY THE PARTIES. READ IT CAREFULLY.

With that in mind, you need to work with a competent Realtor to make sure you understand exactly what everyone’s responsibilities are in the transaction. Once your agent gets some basic information from you, he or she may prepare a contract for you to present to a seller. You need to sit down and discuss each and every detail of the contract. If there is anything you don’t understand, ask. If there is anything they cannot explain well enough for you, ask to speak to their broker.

You will need to make an earnest money deposit to begin with. After certain contingencies have been met, you may even put in a second deposit. Finally, you will come in with a cash portion of a down payment or all cash at closing. Let your agent know if there are contingencies on your obtaining the funds. Even if you are selling stock or getting a HELOC, let them know so he can protect your interests.

If you are getting a loan, see your lender early and plan on giving them a lot of data. Our suggestion is always to work with a local lender as they understand our properties better than those on the mainland. You have a certain amount of time to qualify for your loan and if you don’t do things in a timely manner, you could lose your dream property.

Hawaii law demand the seller give you a property disclosure. Try to obtain this as soon as possible. You want to know what the seller says about the property. If the seller misrepresents something, you will have recourse. You want this even before you have the home inspection we recommend so that the inspector knows if there are special areas of concern.

Be aware each contingency in the contract must be completed on a time schedule by the buyer and the seller. Failure to meet the dates could result in the contract being canceled. If you cannot meet a date, you need to ask for an extension. If the seller cannot meet a date, you need to determine if it is in your best interests to work with them.

The most important thing is to have an agent you trust working in a highly professional and well respected company. In a company such as Coldwell Banker Island Properties, in addition to your agent, you also have a cadre of experienced brokers guiding you and the agent through the transaction. With us, you’ll be in good hands.

You’ve got a great team behind you who will not only follow your direction but give you counsel when needed. What may seem high initially can actually be reasonable when you break it down to the individual costs. What is usually included? To start with, most fees include Water, Sewer, Rubbish service, Landscaping, Pool service, Utilities for Common Elements, Maintenance of the Building, Grounds and Parking lot, Insurance on the building including Hurricane and Liability, Wages and Salary of the Staff , Reserve funds for future Maintenance and even Basic Cable. Some complexes even include electricity in the fees.

Now think about what it would cost to cover these costs for a home? A home needs to be maintained, lawns mowed, yards need to be watered, the pool needs regular service, Homeowners Insurance etc. An absentee owner needs to hire someone for many of these things just to keep the home in basic shape. Also, Maui is an island with limited resources. Unlike the mainland Maui does not have hydroelectric or natural gas generators for power. There are steps you can take to make the move as smooth and stress-free as possible.

To prepare for a purchase if you are not already a full time resident here looking for your primary residence, it is smart to give some thought about what your current and future plans are for yourself and the property.

For instance, do you come 2-6 months a year and want a place to land during those times? Do you want to be able to vacation rent it when you aren't here or do any kind of renting of your property at all? Do you have plans of moving here full time now or in the future but want to buy a property now? Do you want a single family home or a condo that will allow an easy "lock and go" type of scenario? When you do come will you be bringing a pet or a car or your furniture? Are you going to be working full time or retired and what is your lifestyle expectation? Will you be up early surfing every day or will you be telecommuting to your mainland office?

All of these things should be determined first as best as you can, because it will then be easier for you to decide what type of property you should focus on and where it should be located. For example, will you choose a property near the beach or upcountry because you enjoy a view but not the sand, or a single family home or a condo?

There is real convenience in owning a condo or residential condo, where you have maintenance fees but don't have to worry about maintaining the exterior of the house or the yard or anything else. You can just show up and enjoy Maui and when it is time to leave turn out the lights and lock up and go.

With a single family home you have benefits as well, especially if you plan on moving here permanently now or in the future. When considering a house, will you want an Ohana that you can rent out and have someone on site when you aren't here? Or rent out the main house and keep the Ohana for your visits? This type of scenario will allow you to generate some income until you move here full time. But there are also maintenance items to consider like landscaping and the exterior of the property.

If you are planning on moving here permanently, additional questions about bringing furniture and your car typically come up. The correct answer to that question depends on whether you like and own your car outright and like your furniture.

Shipping a container from the mainland to Maui will cost between $6000-$8000 for a 20 to 40 cubic footer. That is probably cheaper than furnishing an entire three or four bedroom house. But if you are bringing your winter chalet furniture to this tropical area and think you want to change your style to a more tropical style, which might not be the best idea. There are furniture stores on island (though they are not cheap). If you are a bargain shopper you can often find some nice pieces at consignment stores or people moving off island who don't want to take their furniture with them.

On the issue of your car, if you own your car outright and like it, it is probably cheaper to ship your car. Shipping your car will cost about $1200 from the West Coast. If you have a newer car, it may be challenging to find something as nice for that price. Peruse the classifieds and Craigslist to get an idea of pricing and supply.

Another consideration are your pets. Until 2003 it was very difficult for pet owners to bring their pets to Hawaii. However, that has changed and there is the opportunity for direct release to you, so your pet does not have to be quarantined, though it does take advance planning. Hawaii is rabies free and state officials are afraid of a possible rabid animal entering the state and coming into contact with an animal such as a mongoose and it spread the disease throughout the islands. Currently Hawaii is the only state free of rabies.

There is a five day quarantine period that comes with standards that must be met by the pet’s owners. Pets that meet the state requirements must be immediately turned over to their owners at the airport or stay a minimum of 5 days at one of the local quarantine stations. If an owner can show proof that their pet has had 2 rabies vaccinations, clean results of blood serum tests or rabies titer, and microchip implantation for identification then the pet can be released to their owner, once a veterinarian has checked the pet at the airport. If the pet is held for 5 days at one of the quarantine stations the cost will be $224. The cost and planning for direct release is pretty extensive and does require advance planning.

If you wish to qualify for apply for the 5 day pet quarantine or direct release option you will want to prepare a minimum of four months in advance by completing the following:

Pets will need to have a microchip implanted to be used in identifying them. All pets will be required to have a booster shot and a rabies shot, which must be no shorter than 3 months apart and 1 year apart. Pets will be required to successfully pass a blood serum test which must be emailed to Hawaii state officials by the testing lab that completed the tests. Also pets are not allowed to enter until after 120 days has passed since the blood sample was received by the state. In order for the pet to be allowed to enter the state and to prevent fraud state officials must receive a health certificate and all test results directly from the pet’s veterinarian. All pets will be inspected at the airport including chip check to confirm the identity of the pet before releasing them to the owner.

There are quite a few variables to consider when deciding what type of property to buy and relocating to Maui or any of the Hawaiian Islands. Homeowners are spending more and more for remodeling their homes. According to Harvard’s Joint Center for Housing Studies, homeowners spent more than $139 Billion on home improvements and repairs over the past year. Understanding the cost and value of home improvements is valuable information to know when considering a remodeling project.

The question to ask yourself is which renovations will increase market value on your home?

Kitchens and bathroom projects are consistently high performers in most markets. When remodeling comes to mind don’t let the higher end projects distract you from you houses main needs. If you have a window that needs replacing or a roof that was poorly maintained, think about focusing on those as well as your new dream kitchen. For example, Canada and Japan have bilateral tax treaties with the US, while China and many other countries do not. Even where treaties are in place, taking title to Hawaii property as a nonresident foreigner may not be the best way to protect it from US and Hawaii taxation.
FIRPTA and HARPTA are fairly simple examples of this, and a good place to start in considering the challenges of owning property in Hawaii—and the huge potential benefits of getting good tax and estate planning advice from the very beginning.

The disposition of a U.S. real property interest by a foreign person (the transferor/seller) is subject to the Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) for federal income tax withholding and HARPTA (Hawaii Real Property Tax Act: Hawaii Revised Statutes Section 235-68), which is patterned after FIRPTA.

The basic rate for FIRPTA is 10% of the gross sales price of the transferred property, and for HARPTA, the basic rate is 5%. The transferee/buyer is responsible for determining whether the seller is a foreign person and for withholding the appropriate amounts and forwarding to the IRS or Hawaii Department of Taxation. It is important to understand that FIRPTA and HARPTA are estimated tax payments (withholding) based on the gross sales price of the subject property, and that in most cases the seller will be entitled to refunds once tax returns for the year of the disposition have been filed.
The following websites are useful for FIRPTA http://www.irs.gov/Individuals/International-Taxpayers/FIRPTA-Withholding and HARPTA http://www6.hawaii.gov/tax/taxfacts/tf2010-01.pdf.

Section P of the Purchase Contract deals with the Foreign and Non-Resident Buyer And/Or Seller. Escrow companies in Maui are reporting that a FIRPTA waiver, if done correctly, may take 90 to 120 days, and the State of Hawaii requires at least 10 business days to approve HARPTA waivers.
Non-resident foreigners must have a ITIN in order to file Form 8288-B, the Application for Withholding Certificate for Disposition by Foreign Persons of US Real Property Interests, which is the relevant form for reduction or elimination of the FIRPTA withholding amount.
If a non-resident foreign buyer does not have an Individual Taxpayer Identification Number (ITIN), it is important to know that the application process (the relevant forms are W-7 and W-7SP) has undergone significant changes as of June 22, 2012 involving more documentation and, of course, considerably more time for processing, which may create delays in closing a real estate transaction where FIRPTA and HARPA are involved.

FIRPTA, HARPTA, ITINs, and the Hawaii Association of Realtors Purchase Contract combine to pose some serious logistical challenges, but these are fairly simple when compared to estate and gift tax issues. Buyers come and go, and look with the intent to buy, and s0metimes change their minds. Buyers will start looking online months before they are planning to buy and the process can take years before they ultimately buy. You will want to make sure the Realtor you select has a good Internet presence. Not just a website, but the ability to get your home visible to anyone who is trying to find it by getting it on all the major search engines that buyers use to search for homes.

Another quality that you will want in the Realtor is the ability and willingness to communicate with you in the manner that you want. Do you want someone who will call, email or text you, or all three? How often do you want to be contacted, after every showing or once a week, or only when there is an offer on the table? Do you want a Realtor who is going to tell you what you want to hear, or one who will be objective and tell you the potentially hard reality that the price you want to sell your home for is not realistic? Do you want a Realtor to help you stage your home even if it means you have to pack up all your tchotchkes that you love so much?

This is an important piece in selecting the right Realtor. If you are not being communicated with how you expect, this can be a source of frustration for everyone. Having a great Internet savvy Realtor is important and the combination of both of these characteristics is crucial. No matter what marketing the Realtor does, the one thing we can’t control is when that buyer who wants to buy your home will show up. However, we can control how often we communicate with you and to do it in the manner you prefer.

If you are not being kept up to date about your property, regardless of how much your Realtor may be marketing your home and working for you, if you don’t know it, then you may feel it isn’t happening, which is likely not accurate. So don’t forget about this characteristic when you select your Realtor.

Our entire world has completely opened up to all of us via the web. But real estate is still a relationship business.
